Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website https://wppowersuite.com/ (the “Site”), the WP PowerSuite WordPress plugin and its modules, and related licensing, updates, and support (together, the “Service”). The Service is owned and operated by Creative Bird (“we,” “us,” or “our”).
Creative Bird is legally registered in the following jurisdictions:
  • Pakistan as a Sole Proprietorship, with its principal office at 4C, Jami Commercial, Khayaban-e-Ittehad, DHA Phase II Ext., Karachi 75660.
  • United States as Creative Bird LLC, a Limited Liability Company registered at 30 N Gould Street, Ste R, Sheridan, Wyoming 82801.
Our primary place of business and operational base is Pakistan. Legal obligations, consumer rights, and applicable laws are governed accordingly, depending on your region.
  • If you are located in Pakistan, these Terms are governed by the laws of Pakistan.
  • If you are located in the United States, certain provisions may be subject to U.S. laws and regulations, primarily under the jurisdiction of Wyoming.
  • If you are located in any other country, these Terms shall be governed by the laws of Pakistan, except where mandatory local consumer law requires otherwise.
Please read these Terms carefully before using the Service. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, customers, and any other individuals who access or interact with the Service.
By accessing or using the Service, purchasing a license, activating a license key, or installing WP PowerSuite, you confirm that you understand and agree to be legally bound by these Terms and our Privacy Policy. If you do not agree to any part of these Terms, you may not access or use the Service.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

1. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you warrant that you meet this age requirement and that you have legal capacity to enter into these Terms. The Service is offered worldwide to businesses and individual website owners.

2. Description of the Service

WP PowerSuite is a commercial modular WordPress plugin. You enable individual modules for administration, security, login and users, content, media, SEO and visibility, performance-related controls, and other site tools. Disabled modules are designed not to load at runtime. Multisite use is supported where WordPress and your license allow.
We may update features, module availability, documentation, and the Site over time. Descriptions on the Site are provided in good faith and do not guarantee that every feature will remain unchanged forever.

3. Accounts and license keys

When you create an account, purchase a license, or activate WP PowerSuite, you must provide accurate, complete, and up-to-date information. Failure to do so may result in suspension or termination of access.
You are responsible for safeguarding passwords, license keys, and credentials used to access the Service, and for all activity under your account or licenses. You agree not to share license keys in a way that exceeds your plan’s site limits or circumvents our licensing controls. You must notify us promptly at support@wppowersuite.com if you become aware of unauthorized use.
License activation, validation, deactivation, and update checks may transmit your license key, associated email, site URL/domain, and plugin version to our licensing systems hosted in connection with wppowersuite.com. Details are in our Privacy Policy.

4. Software license

Portions of the WP PowerSuite plugin are distributed under the GPL v2 or later, as stated in the plugin header. Separately, access to Pro modules, certain freemium capabilities, commercial update delivery, and paid support depends on a valid commercial license purchased from us.
Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable (except as we allow in writing) right to install and use WP PowerSuite on the number of WordPress sites permitted by your license, for sites you own or manage for clients.
Except as permitted by applicable open-source licenses or mandatory law, you may not: resell or publicly redistribute license keys; circumvent license, update, or entitlement controls; remove proprietary notices from commercial materials; or use the Service to build a competing license-circumvention tool.

5. Plans, fees, and taxes

We offer Annual and Lifetime plans. Prices, included sites, and entitlements are shown at checkout. Payments are processed by Stripe, PayPal, and/or WooPayments.
Annual plans cover licensed updates and support for a twelve-month term and may be renewed at https://wppowersuite.com/renew. If your purchase is enrolled in automatic renewal through your payment provider, you are responsible for canceling auto-renewal before the next billing date if you do not wish to be charged again. Lifetime plans are one-time purchases as described at checkout.
Fees may be exclusive of applicable taxes. You are responsible for taxes that apply to your purchase, except where we are required to collect them at checkout.
Failed or overdue payments may result in suspension of Pro entitlements, update access, or support until payment is resolved.

6. Refunds and cancellations

Our refund and cancellation rules are set out in full in the Refund & Cancellation Policy. By placing an order, you agree to that policy.
In summary: eligible purchases may be refunded within 14 days of purchase with no questions asked. Upgrades are not refundable. Canceling a renewal stops future charges but does not by itself refund the current paid period outside the refund rules.

7. Intellectual property

The Site and its original content (excluding content you provide), features, branding, and functionality are and will remain the exclusive property of Creative Bird and its licensors, subject to GPL terms that apply to distributed plugin code. The Service is protected by copyright, trademark, and other laws of Pakistan, the United States, and other countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Your content and feedback

You retain ownership of content on your WordPress sites (including forms, media, snippets, and logs). You are solely responsible for that content and for obtaining rights needed to process it—including when AI modules send content to third-party providers using your API keys.
If you submit feedback, suggestions, or testimonials about WP PowerSuite, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use that feedback to operate and improve the Service, without obligation to compensate you. This does not transfer ownership of your pre-existing intellectual property.

9. AI features

Certain modules can call third-party AI providers using API keys you supply (bring your own key). Creative Bird does not use your prompts, images, or form schemas to train our own models. AI outputs may be inaccurate or incomplete; you must review them before relying on them. Do not use AI features as the sole basis for legal, medical, financial, safety-critical, or similarly high-risk decisions. Your use of each AI provider is also subject to that provider’s terms and privacy policy.

10. Prohibited conduct

You agree not to use the Service to:
  • Violate any applicable local, state, national, or international law or regulation.
  • Infringe upon or violate our intellectual property rights or the intellectual property rights of others.
  • Transmit worms, viruses, or any code of a destructive nature, or use modules (including Code Snippets) to compromise systems you do not own or administer.
  • Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.
  • Collect or track the personal information of others without a lawful basis and appropriate notices.
  • Impersonate any person or entity or misrepresent your affiliation with a person or entity.
  • Send unlawful spam via forms, SMTP, coming-soon subscriptions, or related features.
  • Scrape the Site or license APIs in a way that degrades service or bypasses technical limits, except as allowed by mandatory law.
  • Circumvent licensing, payment, or security controls, or share keys beyond your plan.
  • Misuse AI features to create unlawful, deceptive, or harmful content.

11. Third-party services

The Service may integrate with or link to third-party services you configure or that we use to operate the business (for example payment processors, analytics and advertising platforms, AI providers, OAuth providers, captcha services, and SMTP providers). Those services have their own terms and privacy policies. After you leave our Site or send data to a third party you configure, their policies apply. We are not responsible for third-party outages, charges, or policy changes.

12. Termination

We may terminate or suspend your account, license, or access to the Service immediately, without prior notice or liability, under our reasonable discretion, including but not limited to a breach of these Terms, non-payment, fraud, or security risk.
If you wish to stop using the Service, you may deactivate licenses, uninstall the plugin, and discontinue use of the Site. Canceling renewals and requesting deletion of personal data are described in the Refund & Cancellation Policy and Privacy Policy.
All provisions which by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.

13. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Creative Bird, Creative Bird LLC, its affiliates, directors, employees, partners, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Service; (iv) any bugs, viruses, Trojan horses, or the like that may be transmitted to or through our Service by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Service; or (vi) AI-generated output or third-party integrations.
To the maximum extent permitted by law, our aggregate liability arising out of or related to the Service will not exceed the amounts you paid to us for the Service giving rise to the claim during the twelve (12) months before the claim. Nothing in these Terms excludes liability that cannot be limited under applicable law.

14. Indemnification

You agree to defend, indemnify, and hold harmless Creative Bird and Creative Bird LLC, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including reasonable attorney’s fees) arising from or resulting from your use of and access to the Service, your WordPress site content, your misuse of modules (including snippets and AI submissions), or your breach of these Terms.

15. Disclaimer of warranties

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Creative Bird, its affiliates, and its licensors do not warrant that:
  • The Service will function uninterrupted, secure, or available at any particular time or location.
  • Any errors or defects will be corrected.
  • The Service is free of viruses or other harmful components.
  • The results of using the Service will meet your requirements, including that your site will be secure, faster, fully accessible, or compliant with any particular law or SEO goal.
  • AI outputs will be accurate or suitable for any particular purpose.

16. Governing law

Subject to the regional rules in the introduction of these Terms:
  • For users in Pakistan, and for users outside Pakistan and the United States by default, these Terms are governed by the laws of the Islamic Republic of Pakistan, and you agree that the courts of Karachi, Pakistan (including any applicable consumer court) shall have exclusive jurisdiction over disputes arising from or related to your use of the Service—except where mandatory consumer law requires otherwise.
  • If you are located in the United States, certain provisions of these Terms shall be governed and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. In such cases, legal disputes shall fall under the jurisdiction of the courts of Wyoming, except where mandatory consumer protections require that you may bring claims in your state of residence.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such rights. If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions shall remain in full force and effect.
These Terms, together with the Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and Creative Bird regarding your use of the Service and supersede any prior agreements or communications on that subject.

17. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect where practicable (for example by posting on the Site or emailing a registered purchase email). What constitutes a material change will be determined at our sole discretion, acting reasonably.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
